There will be tougher penalties for those who break the law or fail to comply with tribunal orders, including “personal liability for those that were directors of companies at the time.”
This is a direct quote from Labour’s 2021 Green Paper, ‘A New Deal For Working People.’
What does this mean in practice? If a company fails to pay a tribunal award, then the directors will be personally liable and can be sued in a private capacity for the unpaid monies.
It is likely to be one of the many reforms in Labour’s swift reworking of employment rights, many of which it has pledged to introduce within 100 days of gaining power (if it does).
